The President signed an amendment to eliminate ambiguities in land compensation

Ambiguous interpretations of the current provisions regarding the forms of land compensation should be eliminated. This follows from the amendment to the Act on the Regulation of Ownership Relations to Land and Other Agricultural Property, signed by the President of the Slovak Republic. The legal norm will come into effect on July 1st of this year. Minister of Agriculture and Rural Development Richard Takáč (Smer-SD) announced in his justification of the proposal that the amendment is intended to speed up the lengthy process of satisfying the restitution claims of eligible persons. "The offer of cadastral territories in which the Slovak Land Fund (SPF) or the administrator can provide eligible persons with replacement land will be expanded," he said. At the same time, according to him, the obstacle consisting in insufficient cooperation or complete inaction of the eligible person, who will be provided with compensation from a certain stage of the process, will be overcome. "This also applies to the situation where the entitled person to whom the decision was issued has died or his heirs are no longer acting. This also applies to the situation where the right of the entitled person was not the subject of the inheritance proceedings at all," explained Takáč. If the entitled person does not cooperate, the financial compensation will go into a deposit, according to him, and the SPF will be able to conclude it. If the entitled person reports in the future, he will receive this money. The amendment regulates the procedures of the SPF and the entitled persons, or rather their heirs, and persons who can reasonably be assumed to be the heirs of the entitled person, which will allow the provision of compensation to the previously inactive entitled persons to be concluded without prejudice to their rights. In principle, their claim to land compensation in these cases will be changed to a claim to compensation in money. The legislation also expands the offer of cadastral territories in which the SPF can provide replacement land to the entitled persons, which is intended to contribute to a more dynamic fulfillment of restitution claims. The Ministry of Agriculture and Rural Development of the Slovak Republic emphasized that one of the serious obstacles to the organization of ownership of land, as well as to the creation of appropriate land management relations on land, is the lengthy process of resolving restitution claims of entitled persons. The problems lie in the lengthy decision-making procedures of the relevant state administration bodies, as a result of which, at the end of 2024, 5922 proceedings remained pending, which represents 7.24% of the applied restitution claims.
